Xiaomi Violates Ban | Ericsson Appeals Delhi HC Of Ban Violation



Chinese smartphone manufacturer Xiaomi has been accused of violating the ban placed on it by Delhi High court on 16 December previous year. The ban was placed to restrict sale of handsets without Qualcomm processor although it allowed sales till march 18 on the pre–condition that it deposits INR 100 per handset in the name of Registrar General of the Delhi HC. Devices Redmi Note 4G and Redmi1S continued but Redmi note had to be discontinued because it had Mediatek processor.

Swedish telecom manufacturer – Ericsson has reported Xiaomi is selling handsets through a web portal www.xiaomishop.com. Under a secret arrangement with Indian ecommerce website – Flipkart, the website launches flash sales periodically. These sales infringe on Ericsson’s standard essential patents (SEP). A SEP is patent for core technology essential to create smartphone of technical standard. Phones with GSM, EDGE, WCDMA and GPRS cannot be made by another manufacturer as Ericsson owns their patent. Xiaomi disrupts Ericsson’s patents regarding AMR, EDGE, 2G and 3G technologies.

Xiaomi claims that some third party is misusing Xiaomi’s name and that it has no involvement in the sale of those handsets. Court has currently ordered commissioners to visit customs offices in Mumbai, Chennai, Bengaluru, Delhi, and Kolkata and thorough investigation will take place.
